OVERVIEW: The Suja Organic “Target Gift Card Giveaway & Month Supply of Suja” (“Sweepstakes”) is a Sweepstakes for a chance to win one (1) $500.00 Target gift card and two (3) cases of Suja Organic Protein Shakes (the “Prize”).
SPONSOR AND ADMINISTRATOR: Suja Life, LLC. (“Suja” or “Sponsor”), 3831 Ocean Ranch Blvd, Oceanside, CA 92056.
ELIGIBILITY: The Sweepstakes is open to any current legal resident of the 50 United States or the District of Columbia, who: (i) is eighteen (18) years of age or older at the time of entry; and (ii) enters the Sweepstakes through the method of entry described below (“Entrant”).
Employees of the Sponsor or any of its respective affiliates, subsidiaries, advertising agencies, or any other company or individual involved with the design, production, execution, or distribution of the Sweepstakes and members of their immediate family or persons living in the same household are not eligible to enter or win.
Sponsor reserves the right to verify eligibility at any period during the Sweepstakes. Participation in the Sweepstakes constitutes Entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Sweepstakes. Winning the Prize is contingent upon fulfilling all requirements set forth herein.
CONTEST PERIOD: The Sweepstakes begins on Friday, January 26, 2024 at 07:15 AM (Pacific) and ends on Wednesday January 31, 2024 at 11:59 PM (Pacific) (the “Sweepstakes Period”).
HOW TO ENTER: During the Sweepstakes Period, eligible Entrants must enter the Sweepstakes in the following way (each, an “Entry,” and collectively, “Entries”):
- Follow Suja Organic (@lovesuja) on www.Instagram.com (“Instagram”) during the Sweepstakes Period; and/or
- Follow the link posted on Suja Organic’s social media pages during the Sweepstakes Period, locate the entry form, provide the required entry information, and submit the entry form so it is received no later than 11:59 PM PT on January 31, 2024.
There is a limit of one (1) Entry per Entrant and per email address during the Sweepstakes Period. Notwithstanding the foregoing, Entrants may submit one (1) additional Entry in the following way:
- Tag three (3) friend in the comments section of the @lovesuja Instagram giveaway post launching January 26, 2024
Entry by any method other than as set forth above is void. Any use of automated or programmed methods of effecting an Entry is prohibited. Any attempt by a person to use multiple accounts or identities to gain more entries than permitted by these Official Rules shall result in disqualification at the discretion of Sponsor. Multiple Entrants are not permitted to use the same email account. Odds of winning are determined by the total number of Entries and the total number of Entries is not capped. All Entries must be received before the expiration of the Sweepstakes Period. Non-compliant Entries will not be considered.
Sponsor reserves the right to remove and/or disqualify any Entry that it finds unlawful or in violation of these Official Rules, in its sole discretion. Sponsor is not responsible for lost, late, stolen, incomplete, inaccurate, invalid, unintelligible, garbled, delayed, or misdirected Entries, all of which will be void. Only Entries that fulfill the requirements in these Official Rules are eligible to win the Sweepstakes.
Completing the entry form also constitutes your willful agreement to opt-in to Sponsor’s email marketing list. You may opt-out of the list at any time by using the “unsubscribe” link, which will appear within each of Sponsor’s email messages. If you decide to opt-out, this will not affect your ability to enter the Sweepstakes or your odds of winning a prize in the Sweepstakes. Consenting to receive emails from Sponsor constitutes your agreement to Sponsor’s Privacy Policy at https://Sujaorganic.com/pages/privacy-policy.
SELECTION OF WINNERS: On or about Thursday February 1, 2024, Sponsor or its designee will conduct a random drawing to select one (1) potential winner (“Winner”) from all valid Entries received. The Prize will be awarded upon verification by Sponsor that all Sweepstakes requirements have been met by the Entrant and potential Winner.
The potential Winner will be notified by Sponsor with a request for verification and additional instructions via the email address provided in the Entry. The potential Winner will have seventy-two (72) hours from the time Sponsor sends the notification email to accept the Prize awarded and to execute and return (i) an Affidavit of Eligibility and Release of Liability and Publicity (except where prohibited), (ii) an IRS Form W-9 (if applicable), and (iii) any other information requested for verification.
If the potential Winner is found to be ineligible, is not in compliance with these Official Rules, declines to accept the Prize, or does not comply with Sponsor’s instructions, the Prize may be forfeited, in Sponsor’s sole discretion, and Sponsor will conduct a random drawing to select an alternate Winner from among all remaining eligible Entrants. The alternate Winner is subject to all requirements set forth in these Official Rules. Sponsor shall have no responsibility or obligation to any Winner who is unable or unavailable to accept or utilize the Prize.
PUBLICITY: Except where prohibited, participation in the Sweepstakes constitutes Winner’s consent to Sponsor’s use of Winner’s name, likeness, photograph, voice, opinions, and/or hometown and state for Sweepstakes for all purposes in any media, worldwide, without payment or consideration.
PRIZES: One (1) Winner will receive: (a) one (1) $500 Target gift card and (b) three (3) cases of Suja Organic Protein Shakes with a retail value of approximately $89.82. The Approximate Retail Value of the Prize is $589.82 USD.
There is a limit of one (1) Prize. The Winner must meet all eligibility requirements of these Official Rules to receive the Prize. The Prize must be accepted as awarded and no substitution, transfer, conversion, or assignment of the Prize will be allowed, unless, at the discretion of Sponsor, a substitute Prize of comparable value is awarded because the advertised Prize is unavailable. The Prize is not redeemable for cash and do not include insurance, personal expenses, incidental charges, gratuities, or any other items not specifically described in these Official Rules. The Prize is awarded “AS-IS” and Sponsor makes no representation or warranty, express or implied, including, without limitation, any implied warranty of merchantability or fitness for a particular purpose or any warranty concerning the appearance, safety, or performance of the Prize (or component thereof) awarded. Sponsor expressly disclaims any responsibility or liability for injury or loss to any person or property relating to the delivery and/or subsequent use of the Prize awarded.
All fees, federal, state, local, and other taxes on the Prize, if any, are the sole responsibility of the Winner. The value of the Prize must be declared as ordinary income and will be taxable to the Winner accordingly. If required by law, Sponsor will require payment from the Winner of taxes to be remitted to the appropriate taxing authorities. The potential Winner should consult with their tax advisor regarding any questions or concerns.
GENERAL: Decisions of Sponsor are final and binding in all matters related to these Official Sweepstakes Rules and the selection of the Winner. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations and is void where prohibited by law.
By participating in the Sweepstakes, Entrant agrees (i) to be bound by these Official Rules and Sponsor’s decisions, and (ii) to indemnify and hold Sponsor and Sponsor’s directors, officers, shareholders, employees, agents, and representatives (collectively, the “Released Parties”) harmless from any and all claims, liabilities, losses, and damages of any kind arising in whole or in part, directly or indirectly, from Entrant’s participation in the Sweepstakes and acceptance, possession, use, or misuse of the Prize.
Sponsor reserves the right to cancel, modify, or suspend the Sweepstakes or any element thereof (including, without limitation, these Official Rules) without notice in any manner and for any reason (including, without limitation, in the event of any unanticipated occurrence that is not fully addressed in these Official Rules). In the event of cancellation, modification, or suspension, Sponsor reserves the right to select a Winner from among all eligible Entries received prior to the time of the event warranting such cancellation, modification, or suspension. Notice of such cancellation, modification, or suspension will be posted on the Sweepstakes website. Sponsor reserves the right to modify these Official Rules for clarification purposes without materially affecting the terms and conditions of the Sweepstakes.
Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law.
Any third-party trademarks, service marks and trade names referenced herein are the property of their respective owners, are used for descriptive purposes only, and do not imply any sponsorship or endorsement of this Sweepstakes.
Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
PRIVACY POLICY: All personal information submitted to Sponsor is subject to Sponsor’s privacy policy (“Privacy Policy”) located at https://Sujaorganic.com/pages/privacy-policy. Please review the Privacy Policy before submitting your entry. If you object to the above or anything stated in the Privacy Policy, you should not enter the Sweepstakes.
LIMITATIONS OF LIABILITY: EXCEPT WHERE PROHIBITED, ENTRANT EXPRESSLY UNDERSTANDS AND AGREES THAT THE RELEASED PARTIES SHALL NOT BE LIABLE FOR AND HEREBY RELEASES THE RELEASED PARTIES FROM ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF SPONSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (i) THE INABILITY TO PARTICIPATE IN THE SWEEPSTAKES; (ii) UNAUTHORIZED ACCESS TO OR ALTERATION OF TRANSMISSIONS OR DATA; (iii) STATEMENTS OR CONDUCT OF ANY THIRD PARTY; OR (iv) ANY OTHER MATTER RELATING TO THE OPERATION OF THE SWEEPSTAKES. Released Parties are not responsible for telecommunications, network, electronic, technical, or computer failures of any kind; for inaccurate transcription of entry information; for errors in any Sweepstakes or marketing materials or in these Official Rules; for any human or electronic error; or any injury, illness, or damage to persons or property, including bodily injury and death, which may be caused, directly or indirectly, in whole or in part, from Entrant’s participation in the Sweepstakes or Winner’s receipt or use or misuse of the Prize or any component thereof.
DISPUTES: By entering the Sweepstakes, Entrant agrees that all disputes, claims, and causes of action arising out of or relating to the Sweepstakes or the Prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by a federal or state court in San Diego County, California, except where prohibited. Any awards or judgments shall be limited to actual out-of-pocket costs incurred, but in no event shall include attorneys’ fees. Under no circumstances shall any Entrant be permitted to obtain an award for, and Entrant hereby waives all rights to claim, any punitive, incidental, or consequential damages and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of the Entrant or Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of California.
RECORD OF WINNER: For a record of the Winner, available within thirty (30) days after the end of the Sweepstakes Period, send an email to sarah@sujalife.com. Winner may also be announced on the Sponsor’s website and/or social media account(s), at Sponsor’s sole discretion.
